Parent/Student Rights under Section 504 of the Rehabilitation Act of 1973 and ADAAA of 2008

Section 504 of the 1973 Rehabilitation Act and its amendment ADAAA of 2008 is a nondiscrimination statute barring discrimination on the basis of disability. It is the policy of Bethany Community School in its educational programs, activities, or employment policies as required by this Act.

1. Be informed by the school of your rights under Section 504, which is the purpose of this notice.

2. Your student has the right to an appropriate education designed to meet his/ her individual educational needs as adequately as the needs of non-disabled students are met.
3. Your student has a right to placement in the least restrictive environment.

4. Your student has a right to facilities, services, and activities that are comparable to those provided for non-disabled students.

5. Your student has a right to a pre-placement evaluation that is tailored to assess specific areas of need.

6. Receive notice with respect to identification, evaluation, or placement of your child.

7. Have eligibility and educational placement decisions made based upon a variety of information sources, and by individuals who know the student, the eligibility data, and placement options.

8. Have a right to periodic re-evaluation and evaluation before any significant change in placement.

9. Give your child an equal opportunity to participate in nonacademic and extracurricular activities offered by the school district through the provision of reasonable accommodations.

10. Receive a response from the school to reasonable requests for explanations and interpretations of your child's records.

11. Examine all relevant records relating to decisions regarding your child's identification, eligibility, educational program and placement under the Family Educational Rights and Privacy Act.

12. Request amendment of your child's educational records if there is reasonable cause to believe that they are inaccurate, misleading or otherwise in violation of the privacy rights of your child. If the school refuses this request, it shall notify you within a reasonable time, and advise you of the right to a hearing.

13. Seek resolution regarding a disagreement with decisions made by school personnel by filing a grievance with the school’s Director of Operations.
